Appellant was charged by affidavit in one count with the crime of theft. The cause was tried by jury which rendered a verdict finding defendant guilty as charged in the affidavit. Thereafter the court entered judgment that appellant be imprisoned in the Indiana Womens Prison for not less than one (1) year nor more than ten (10) years and be fined Two Hundred ($200.00) Dollars and costs. From this judgment stems this appeal.
